This page says what you can get back, and when, for each thing you can pay us for: a site assessment fee, a project deposit and balance on work performed, and a service agreement. It is written in plain language on purpose. Please read them.
Who we are. North Carolina Land Ops LLC is a North Carolina limited liability company with its principal office in Broadway, Harnett County, North Carolina. North Carolina Land Ops and NC Land Ops are its trade names. In these terms, "we," "us" and "the company" mean North Carolina Land Ops LLC, and "you" means the person using the site or dealing with us.
What these terms do not replace. The terms you agree to when you book an assessment, accept an estimate or sign a service agreement are the terms that govern; this page restates them in one place, and where the two differ, the signed document controls. Our Terms of Service apply as well.
1 The short version
Assessment fee. Refunded in full if you cancel four hours or more before the visit, or if we cancel. Earned once the visit is performed. Credited back in full on your final invoice when your job is completed to the plan.
Project deposit. Refunded in full if you cancel more than thirty days before your start window. A share is retained closer to the start, on a schedule stated in your estimate. Refunded in full if we cancel.
Rescheduling is never a cancellation. Weather, ground conditions and our own delays never cost you anything.
Nothing is charged without your written approval.
Refunds go back the way you paid, within ten business days of our confirmation.
2 The site assessment fee
Who pays it. For a landowner whose property is in our Core tier, the on-site assessment is free, and nothing on this page about the fee applies to you. For a business, builder, Realtor or land investor in the Core tier, and for every customer in the Extended and Expanded tiers, the assessment carries a flat fee set by tier, shown before you pay. It includes any sales tax that applies.
Cancelling. Cancel four hours or more before the appointment, through the link in your confirmation, and the fee is refunded in full. Cancel less than four hours before, or after the visit has been performed, and the fee is earned and is not refunded.
If we cancel. If we cancel for any reason, including weather, safety or scheduling, the fee is refunded in full, or applied to a rescheduled visit, at your choice.
Rescheduling. You may reschedule once, without charge, to a mutually agreed date within thirty days; the fee carries over.
The credit. If you go ahead with the work and the job is completed as described in your written plan, the full fee is credited against the balance on your final invoice. If the job is ended before the work in the plan is complete, by you or for any reason other than our cancellation, the fee stays earned for the assessment and is not credited.
3 The project deposit and balance
The deposit. When you accept an estimate, a scheduling deposit of half the project price is due. It reserves a production day and the equipment for it; we do not hold dates without it. On a phased project the deposit is half of the first phase.
Rescheduling. A schedule change is not a cancellation. A project may be rescheduled once, at no cost and with the full deposit preserved, to a mutually agreed date within sixty days of the original start window. Delays caused by weather, ground conditions or by us are always reschedules, never cancellations, and never affect your deposit.
If you cancel. The deposit reserves a day and equipment that are difficult or impossible to refill on short notice, and the loss grows as the start date approaches. The schedule below is a reasonable estimate of our actual loss, not a penalty:
More than thirty days before the start window: 100% of the deposit is refunded.
Fifteen to thirty days before: 75% of the deposit refunded / 25% is retained .
Eight to fourteen days before: 50% of the deposit refunded / 50% is retained.
Seven days or less before: Zero % of the deposit is refunded / 100% of the deposit is retained, because equipment is reserved and the production day cannot be refilled.
Where we are able to refill the cancelled day, the retained amount is refunded to the extent of the replacement work.
If we cancel. If we cancel for any reason, including safety, ground conditions, equipment availability or our own scheduling, the deposit is refunded in full, less the value of any work already performed and accepted.
Phased projects. You may stop after any completed and paid phase, owing nothing further. A project that is no longer continuous, because of a seasonal gap, a re-mobilization or a new equipment reservation, returns as a new engagement with a fresh deposit.
The balance. The balance is due when the work is complete and you have accepted it at the walkthrough. Work that has been completed and accepted is not refunded. If something is wrong, tell us at the walkthrough or in writing, and we correct it under your plan before the job is closed.
ESTIMATES ACCEPTED AT A RESIDENCE AFTER AN ON-SITE VISIT MAY BE CANCELLED WITHOUT PENALTY OR OBLIGATION UNTIL MIDNIGHT OF THE THIRD BUSINESS DAY AND RECEIVE A FULL REFUND IN ACCORDANCE WITH NORTH CAROLINA'S RIGHT TO CANCEL STATUTE (NC G.S. § 25A-39 AND § 14-401.13. (Business days include Saturdays, but exclude Sundays and federal holidays.)
4 Changes and conditions we could not see
Changes to the work are agreed in writing before the work proceeds, and nothing is charged without your written approval. If we find conditions materially different from what we assessed, such as rock, buried debris, buried wire or fencing, saturated ground or vegetation much denser than observed, we stop, document the condition with photographs, and present a written change for your approval.
If you decline the change, we complete the work the plan allows outside the affected area, you pay for the work completed, and any deposit beyond that is refunded.
5 When the work is done
We walk the finished work with you where practicable, and acceptance is measured against the completion standard in your written plan. Items identified at the walkthrough are corrected before the job is closed. After acceptance, the work is not refunded; the standard in the plan is the warranty we give, and plants regrow. If you were not present at the walkthrough, we send you the completion record and photographs, and you have seven days to tell us of any objection before the work is treated as accepted.
6 Service agreements
Weather. A scheduled visit is moved for weather or ground conditions without penalty to either of us, and rescheduled within the window or to the earliest workable date.
A visit we cannot perform. If we are unable to perform a scheduled visit within the term, your account is credited or refunded for that visit at its per-visit value.
A visit you postpone. If you deny access or postpone a confirmed visit within seven days of its date, the visit may be rescheduled once; a second postponement within the same window is treated as a completed visit unless we agree otherwise.
Cancelling the agreement. Either of us may cancel during the term on thirty days' written notice. On cancellation you pay for the visits completed; unused prepaid amounts are refunded pro rata; and any discount given for annual prepayment is recalculated against the visits actually performed. If we cancel for cause, safety or site conditions, the same terms apply.
Renewals. Service agreements do not auto-renew. Renewals are renegotiated generally within 30-60 days prior to expiration. It is requested that you provide intent to renew or cancel within this 30-60 day window.
7 How refunds are paid
A refund goes back to the payment method you used. We confirm the refund in writing and issue it within ten business days of that confirmation; your bank or card issuer may take several more days to post it. A refund by check goes to the address we have for you. Sales tax that was included in a refunded amount is refunded with it. A convenience fee charged for an electronic payment is not refunded.
8 What is not refunded
A site assessment that has been performed. Work that has been completed and accepted. The share of a deposit the schedule in section 3 retains, except where we refill the day. A service visit treated as completed under section 6.
9 How to cancel or request a refund
An assessment: use the link in your booking confirmation, or email or call us.
A project or a service agreement: email us, so there is a record, or call us and we will confirm in writing.
Tell us the property address and the date. We confirm every cancellation and every refund in writing. If you believe a charge is wrong, contact us before disputing it with your card issuer; we resolve it faster than a dispute does, and a dispute does not change what this page says you are owed.
