Effective date: 2026-07-01 · Last Update: 2026-10-23
These terms govern your use of nclandops.com, the forms and tools on it, and the calls, text messages and emails we exchange with you. They are written in plain language on purpose. Please read them.
Who we are. North Carolina Land Ops LLC is a North Carolina limited liability company with its principal office in Broadway, Harnett County, North Carolina. North Carolina Land Ops and NC Land Ops are its trade names. In these terms, "we," "us" and "the company" mean North Carolina Land Ops LLC, and "you" means the person using the site or dealing with us.
What these terms do not replace. Work on your land is done under a written plan and estimate that you accept, and in some cases a written service agreement. Those signed documents govern the work. Where they and these terms differ, the signed documents control.
1 Accepting these terms
By using this site, sending us a form, booking an assessment or opting in to our text messages, you accept these terms. If you do not accept them, do not use the site. You must be 18 or older to send us a form, book an assessment or contract for work on a property.
2 What we do
We are a land management company. We clear and manage land for property owners, and we deliver the work against a written plan at a fixed price. The services we offer are described on this site.
Some land work in North Carolina requires a contractor license. We accept a job that requires a license only when we hold the license it requires. Where part of a job calls for a licensed trade, your written plan names who performs that part.
3 Where we work
We serve the North Carolina counties listed on our Service Area page, in three tiers: Core, Extended and Expanded. The tier your property is in determines whether an on-site assessment carries a fee (section 9). Properties outside those counties are not served.
4 The site is information, not an offer or advice
This site describes how we work and what our work looks like. It is general information. It is not engineering, surveying, forestry, environmental, tax or legal advice about your property, and it does not replace a determination by a licensed professional where one is required.
Nothing on this site is an offer to perform work at a price. An offer exists only in a written estimate we issue to you. A contract for work exists only when you accept that estimate in writing and pay the deposit it states. We may change the content of this site at any time.
5 How we contact each other
When you send a form, call, text or email us, you give us a way to reach you. You agree that we may contact you about your inquiry, your assessment and your job by phone, text message and email at the details you gave us. When you send a form, an automated message confirms that we received it. A person then follows up.
Automated assistants. Some calls and messages are answered first by an automated assistant. It tells you it is automated. It can take your property details, answer questions about how we work, and set up a call with a person. It cannot give you a price for your job, accept or decline a job, change a plan or an estimate, commit the company to anything, or discuss financing. A person does those things.
Recorded calls. Calls to and from our number may be recorded or transcribed so that we have an accurate record of what was discussed about your property. If you do not agree to your call being recorded, do not call, use email or text message instead.
Email. Emails about your inquiry or your job are business communications. Any email we send for marketing includes a way to unsubscribe.
6 Text Messages
The program. When you give us your mobile number and agree to receive text messages, you consent to receive texts from North Carolina Land Ops LLC at that number, sent from (910) 996-5263. The messages are about your inquiry and your job: confirmation that we received your request, scheduling and reminders for your assessment, updates and questions during the work, documents and payment confirmations, and a request for your feedback when the job is done. If you separately opt in to them, we may also send occasional seasonal information and offers. Messages may be sent by an automated system.
Frequency and cost. Message frequency varies with your inquiry and your job. Message and data rates may apply. Agreeing to receive texts is not a condition of buying anything from us.
To stop. Reply STOP to any message. You will receive one message confirming that you are unsubscribed, and no further texts unless you opt in again. Stopping texts does not stop work you have contracted for; we will reach you by phone or email instead.
For help. Reply HELP to any message, email [email protected], or call (910) 996-5263.
Carriers. Wireless carriers are not liable for delayed or undelivered messages.
Your number. If you change or give up your mobile number, tell us so we do not text the new holder of that number.
Your information. How we handle the information you give us is described in our Privacy Policy.
7 Your Information
Our Privacy Policy explains what we collect, how we use it and the choices you have. In short: we use your information to look at your property and follow up with you about it, to plan and perform the work, and to keep the records the work requires. When you ask about a property, we may retrieve public records about that parcel, including the owner of record, the parcel boundary, aerial photography and elevation data, to prepare for the conversation.
8 The online assessment tool and price ranges
What the tool does. This site offers a self-service assessment tool. You enter information about your property and the work you want, and the tool shows you a cost range. The range is built from your answers and from public records about the parcel: the county parcel map, the state's aerial photography and, where it exists, the federal laser survey of the land. Those records are the newest their sources hold and may not be from the current year.
What the range is. The range is not a price, not an estimate and not an offer. It is non-binding. It does not set or limit the price of any work. It is shown only to the person who entered the information, and a person from our company follows up with you about it. The only price we stand behind is the fixed price in a written plan and estimate, prepared after we have looked at the property.
The same is true of any range a member of our team gives you before an on-site visit, from maps and imagery. It is a range, not a price, and the written plan replaces it.
What you confirm when you use it. You confirm that the information you enter is accurate to the best of your knowledge and that you own the property or are authorized by the owner to ask about work on it.
What the tool is for. The tool is for landowners, and the people acting for them, who are considering work on a property. You may not use it, or any part of this site, to collect our pricing systematically, to probe how our pricing is built, or to build a competing service. Section 15 applies.
9 On-site assessments and the site assessment fee
The assessment. An on-site assessment is a visit to your property. We walk it with you, look at what is growing and how the ground lies, and prepare a written plan and a fixed price. It is not engineering, surveying, environmental or legal advice.
Who pays a fee. For a landowner whose property is in our Core tier, the on-site assessment is free. For a business, builder, Realtor or land investor in the Core tier, and for every customer in the Extended and Expanded tiers, the assessment carries a flat site assessment fee. The amount for your county and situation is shown before you pay, and it includes any sales tax that applies. Every customer in the same situation pays the same amount.
How the fee works. The fee is collected when the assessment is booked. It is refunded in full if you cancel four hours or more before the appointment, or if we cancel. If you cancel less than four hours before, or once the assessment has been performed, the fee is earned and is not refunded. You may reschedule once at no charge. If you go ahead with the work and the job is completed as described in your written plan, the full fee is credited against the balance on your final invoice. If the job ends before the work in the plan is complete, the fee stays earned and is not credited.
The document that controls. The full terms are in the Site Assessment Scheduling Confirmation you agree to when you book, and that document controls. You can cancel or reschedule through the link in your confirmation.
10 Estimates, plans and agreements
The written plan. After the assessment we give you a written plan and estimate. It states the work, the area and its boundaries, the finished condition you will receive, what is not included, the schedule, and one fixed price for the work in the plan, together with any separate lines the estimate states, such as mobilization. Fixed price means the price does not change with the hours or days the work actually takes, provided the site is as it was when we assessed it.
Validity. An estimate is valid for thirty days from its date. After that we re-quote it, promptly and at no charge.
Deposit and balance. A scheduling deposit, stated in the estimate, is due when you accept it. The deposit reserves a production day and the equipment for it; we do not hold dates without it. The balance is due when the work is complete and you have accepted it at the walkthrough. A phased project is billed by phase, as the estimate states.
Changes. Changes to the work are agreed in writing before the work proceeds. If we find conditions materially different from what we assessed, such as rock, buried debris, buried wire or fencing, saturated ground or vegetation much denser than observed, we stop, document the condition with photographs, and present a written change for your approval. Nothing is charged without your written approval.
Recurring work. Scheduled maintenance of land already brought to a standard is provided under a written service agreement with its own terms.
What governs the work. The estimate, the service agreement where one applies, and any written change orders are the agreement between us for the work. These terms do not change them.
11 Rescheduling and cancellation
Rescheduling. Schedule changes are not cancellations. A project may be rescheduled once at no cost, with the full deposit preserved, to a mutually agreed date within sixty days of the original start window. Delays caused by weather, ground conditions or by us are always reschedules, never cancellations, and never affect your deposit.
If you cancel. If you cancel more than thirty days before the start window, the deposit is refunded in full. Closer to the start, a share of the deposit is retained on the schedule stated in your estimate, because the production day and the equipment reserved for it are hard to refill on short notice. Where we are able to refill the day, we refund the retained amount to the extent of the replacement work.
If we cancel. If we cancel for any reason, the deposit is refunded in full, less the value of any work already performed and accepted.
12 Your responsibilities as a property owner
Authority. When you ask us to work on a property, you confirm that you own it or are authorized by the owner to contract for the work, and that any approval needed from a co-owner, trustee, tenant, lender, association or easement holder has been obtained.
Site disclosure. Before work begins, you complete our site disclosure checklist with us. You identify, in writing and on the ground, what you know about septic tanks and drain fields, wells, water, sewer, gas, electrical, irrigation and communications lines, buried fencing, cable or wire, property corners and boundaries, and the trees, structures and features you want kept. Items you mark as unknown are treated as present until verified.
Utility locates. We request a utility locate through NC 811 before ground-engaging work. A locate marks public utility lines only. It does not mark private lines, septic systems, irrigation or buried fencing. That is why your disclosure matters.
Access and conditions. You provide access for equipment, secure animals and occupants during the work, and tell us about new hazards, boundary changes or restrictions you become aware of.
Permits and approvals. Permits, easements, covenants and association approvals that apply to your property are your responsibility. We identify the permit requirements we recognize, and we do not warrant that we have identified them all. [ATTORNEY REVIEW — mirrors the bracketed permits clause of the estimate (Legal Review Request E4); conform to whatever counsel approves there.]
Undisclosed features. Features you did not disclose and that could not reasonably be seen are at your risk. Their repair, and the repair of our equipment damaged by undisclosed buried metal, is charged at cost by written change order.
13 Payment
Payment methods. We accept the payment methods stated on your estimate or booking page. Any charge for using a particular payment method is shown before you pay. Payments are processed by a third-party payment processor; we do not store your full card number. Sales tax, where it applies, is stated on your estimate.
Non-payment. Payment problems are easier to solve early. If you cannot pay on time, call us before the due date. If a balance is not paid within [ten] days of its due date, the following apply:
Interest. The unpaid balance bears interest at the North Carolina legal rate, eight percent (8.0%) a year (G.S. 24-1), from the due date until it is paid.
Work pauses. We do not begin the next phase of a phased project, and we may suspend scheduled visits under a service agreement, until the balance is paid.
Returned payments. A check returned for insufficient funds or a closed account carries the processing fee North Carolina law allows, currently $35 (G.S. 25-3-506).
Written notice. Before collection or a lien, we send you written notice of the balance, the interest, and what follows if it is not paid.
Collection costs and attorney's fees. If we refer the balance to an attorney for collection, you pay our reasonable attorney's fees and collection costs to the extent North Carolina law allows (G.S. 6-21.2). You have five days from the mailing of our notice to pay the balance without those fees.
A lien on the property. Clearing, grading, filling and landscaping are improvements to real property under North Carolina's lien law (G.S. 44A-7(4)), and a contractor who is not paid for an improvement has the right to file a claim of lien on the property improved (G.S. 44A-8). If the balance is not paid, we may file a claim of lien on the property with the clerk of superior court in the county where it lies, within 120 days after our last day of work on the site (G.S. 44A-12), and enforce it by court action within 180 days (G.S. 44A-13). A lien takes effect from our first day of work on the site (G.S. 44A-10), and it is cancelled when the balance is paid.
Lien agent. For a project of $40,000 or more on property other than the home you live in, North Carolina law requires you, the owner, to designate a lien agent before you contract for the work and to tell us who it is within seven days of our written request (G.S. 44A-11.1, 44A-11.2). We may send a notice to that lien agent when work begins. That notice is a routine step that preserves our rights; it is not a lien, and it does not mean anything is owed.
Sales Tax. North Carolina Department of Revenue taxes services to real property unless the work is a capital improvement. The work we do is a capital improvement under the State's definition, which covers new construction, roads and driveways, and work that modifies the living elements of land, and the Department of Revenue's own chart lists land clearing, grading, site preparation, debris removal and the removal of trees and shrubs as capital improvements (G.S. 105-164.3(31); G.S. 105-164.4H).
Landowners sign North Carolina Form E-589CI, Affidavit of Capital Improvement, for the project, and we keep it with the job record. On a capital improvement no sales tax is charged and none appears on the invoice; the tax we pay on our own fuel, parts and equipment is inside our price.
If a plan also includes unrelated taxable work, such as a gate, a culvert or a gravel drive, the estimate prices it on its own line, and if that work is more than a quarter of the contract price, sales tax applies to that line at the rate for the county where the work is performed and the estimate shows it (G.S. 105-164.4H(d)). If the State later determines that work was not a capital improvement, the law places any additional tax on the person who signed the affidavit (G.S. 105-164.4H(a1)).
The site assessment fee (if any) includes any sales tax that applies.
14 Financing
North Carolina Land Ops LLC is not a lender and does not arrange, broker, or provide financing. We receive no compensation, fee, or consideration of any kind from any lender or financing provider. We do not make or influence credit decisions and do not recommend any specific lender. This information is general education only and is not financial, tax, or legal advice. Compare terms independently and consult your own advisors before borrowing.
No one at the company will quote you a rate or a payment, complete a financing application for you, or comment on your credit.
15 Our content, our methods and what you may do with them
The site. The site, its text, photographs, graphics and logos, and the names North Carolina Land Ops and NC Land Ops, belong to North Carolina Land Ops LLC. You may view the site and save or print pages for your own use in considering our services.
Documents we prepare for you. Plans, estimates, assessment reports and cost ranges are prepared for you, to decide on work on your property. You may share them with your advisors, lender, co-owners and anyone helping you decide. They may not be republished, or used to build a pricing tool or a competing service.
Our methods. We estimate production and price from a proprietary classification method. The method, its factors and its values are trade secrets of the company. You may not use the site or the assessment tool to extract, reconstruct or test them, whether by repeated queries, automated access or any other means.
16 Acceptable use
Use the site lawfully and honestly. Do not enter another person's contact details or property without their authority. Do not give false information. Do not use bots, scrapers or automated tools on the site. Do not interfere with the site or its security. Do not send or post anything unlawful, defamatory or infringing.
17 Reviews and material you send us
Reviews. We ask every client for an honest review at the end of a job. We do not pay or offer anything for a review, and we do not condition anything on a review or a rating. Reviews you post on public platforms are governed by those platforms' rules.
Material you send us. If you send us photographs, descriptions or other material about your property, you keep ownership of it and you give us permission to use it to assess, plan and perform the work and to keep the job record.
Our photographs of your property. We photograph our work at assessment, during the job and at completion, for the job record. We publish a photograph of a client's property only with the client's agreement, and we leave out house numbers, vehicles and faces unless you agree otherwise.
18 Third-party services and links
We use third-party services to run this site, manage inquiries and schedules, send messages, take payments and look up public property records, including county parcel data published through NC OneMap and federal elevation data. Those services have their own terms, and we do not control their content or availability and are not liable for the accuracy of their data. It is for this reason that cost range estimates generated through the Site are non-binding on either party and all formal estimates are generated for on-site assessments and written plans and estimates.
Any links to other websites are provided for convenience and are not endorsements.
19 Insurance, safety and the standard of our work
Insurance. We carry commercial insurance for our work. A certificate of insurance is available on request and is issued directly by the carrier or broker.
Safety. Field work is performed under our documented safety program. A pre-operation inspection with a recorded go or no-go decision is completed before equipment starts each day, and no machine operates on a no-go.
The standard of our work. Our work is delivered to the completion standard stated in your written plan and accepted at the walkthrough with you. Items identified at the walkthrough are corrected before the job is closed. That standard is the warranty we give on the work. Vegetation regrows; regrowth after the job is not a defect.
20 Disclaimers and limits on our liability
This site is provided as it is. We do not warrant that it will be error-free or always available. To the extent North Carolina law allows, we are not liable for indirect, incidental, consequential or punitive damages arising from your use of the site, the assessment tool or our communications, and our total liability for any claim arising from the site is limited to the amount you paid us through the site in the twelve months before the claim. Liability for work on your property is governed by your written estimate or service agreement.
21 Indemnification
You agree to indemnify and hold the company harmless from claims, losses and expenses arising from your breach of these terms, from information you gave us that was false, or from your use of the site in violation of law.
22 Governing law and disputes
These terms are governed by the laws of Harnett County in the State of North Carolina. If a dispute arises, call us first. We will try to resolve it by talking before either of us starts a proceeding.
23 Electronic communications and signatures
You agree that we may send notices, confirmations, plans, estimates, invoices and other documents to the email address or mobile number you gave us, and that an electronic signature or a typed acceptance you give us is as binding as a handwritten signature.
24 Changes to these terms
We may update these terms. The effective date at the top is the date the current version took effect, and changes apply from the date they are posted. If we change the text message program in a material way, we tell you by text first. Using the site after a change means you accept it. The terms you agreed to when you booked an assessment or accepted an estimate continue to govern that transaction.
25 General
If any part of these terms is found unenforceable, the rest stands. Our not enforcing a term is not a waiver of it. These terms, the Privacy Policy, and the documents named in sections 9 and 10 are the whole agreement between us about the use of this site and our services.
